burning about 2:30 this morning. that's when the flames were first spotted. we did talk to the woman who lives inside this home. she talked to us about how she was woken up by a passing driver. >> i was sleeping and somebody was banging downstairs and i went out and found the next door's house totally engulfed in flames. >> i got out. we got out. we turned on our hose that we tried and -- i was sprinkling down here. eric was sprinkling on the top and we were both told to stop. >> reporter: all right. a lot of challenges out here this morning. the reason they were told to stop is because firefighters said they were not in a safe place. they had a couple of issues. first, there are no fire hydrants near this home. so they had to bring in water trucks. second, a fire station a mile away was closed. so they had to go further, five more miles away to get here. and then had you a fire line that came down from the fire. when this came down that brought down live wires.

firefighters say that brought about 90 minutes for pg&e to turn the power off. they had to hang back, we adjust the lines while that happened. now back out here live, you see the continual problem is getting water where it needs to be. as you see this roof is in place, the fire has broken through it. but the roof is still there which makes all of the where the they are putting up there difficult. you have firefighters on the back end of this home getting where the that's on the other side of the hill. you have water tenders on this side. the reason this house is built this way, it's actually a floodplain. so they were told when they built this house in the '90s that they had to build it up high. this house is made of cedar. the woman who lives here said that was trucked in from washington. the wood was from canada and the fire has a lot of fuel to burn. that's what it's doing. they just can't get to it. so they are trying this plan. if this doesn't work, they are

topics on the meets with the israeli leaders. well, now we're less than a week away from the day the u.s. supreme court will hear oral arguments on proposition 8. next tuesday the court will hear arguments before or against prop 8 along with another same-sex marriage case. the challenge to the federal defensive marriage act. yesterday, the court said it would release same-day audio if the arguments are presented. the court's statement did not mention television coverage which legal experts probably means it will not be allowed. a bay area consumer group warning about potential hidden fees with oakland's municipal i.d. card. the city created these i.d. cards in part for undocument emergencied immigrants. a debit function was -- undocumented immigrants. a debit function was put in

place. there's hidden fees. there are fees for enrolling and and another fee for every time it's used. b.a.r.t. is dealing with a big bird problem. it's expected to cost the transit agency millions of dollars. brian flores is live in fremont to explain the problem. good morning, brian. >> reporter: good morning, tori. it certainly can be a very dirty problems at times. these pigeons are causing a lot of damage at most of the b.a.r.t. stations throughout the bay area. it's costing them millions of dollars. in fact, the agency says they spent up to $2 million to lay down spike strips sure birds don't land there. another million is being spent to deal with pigeons at five east basis stas. pigeons are a concern at two

other stations. ironically, b.a.r.t. says the birds are adapting to the measures like the stripe strips. in fact, some say they are starting to lay eggs. they are not only dealing with the birds but also the cleanup as well. and b.a.r.t. is being careful about the habitat. crews having to tunnel around a known bird habitat and that's costing the agency another $5 million to deal with that. a few years ago, the agency instilled recorded bird noises of hawks and eagles meant to drive away pigeons. they say they've installed those sounds at all of the b.a.r.t. stations, including the newly- built station in fremont. we're live here in fremont, i'm brian flores, ktvu channel 2 news. >> all right, brian. 7:07. a lot happening in our commute this morning. a lot of crashes, the roads are wet. sal, what are you seeing? >> reporter: westbound 9, a

little -- westbound 92, a little bit slow there because of a crash at the toll plaza. we looked at the actual san mateo bridge. that's okay because people are not getting by that well. westbound 92. they are trying to remove this crash from the san mateo bridge. we're also looking at a livermore commute. it's been busy. people are driving -- some people -- i just got a tweet from someone, tell people to slow down they are driving too fast for the conditions. that's not a very good thing when the road are wet. we had some earlier problems at the walnut creek interchange. let's go to go to live picture at the toll plaza. not too bad. about a 20-minute delay at the toll plaza. northbound 280 traffic is looking good. there was an earlier stall near

caesar chaves. steve. we have cloudy skies. santa rosa, napa airport, both are reporting light rain. we could sure use a lot more. this system looks like decreasing throughout the day. any precip. i think the heaviest was last night. santa rosa was doing really well in the rain, 24.5. now 79% of normal. san jose, 70% of normal. i want to make a correction here. i -- i originally -- about a half-hour ago, i said one of the driest marches ever in san francisco, it's the 20th driest march. it is january, february, march, the driest three-month stretch in san francisco so far. only 1.66 inches of rain has fallen. we need another 1.50 plus to go into second place. i doubt that happens. so again we're in record- setting territory for lack of rain. i just saw -- came across on twitter from the national weather service in mobile, alabama, last year they were running about 48 degrees above average, this year to 28 below.

what a -- 2 to 8 below. what a difference. this is a very mild system coming up from the southwest. there could still be a little bit more rain. you will start to see some clearing taking place north to south. rainfall totals, most of it fell about .10 to .25 to .030. still some light rain in there. you can see the cloud cover continues to stream in here. temperatures, though really on the mild side. 50s for almost everybody except for a few upper 40s. this moisture source coming up -- down by the equator, it's really giving us a mild day. cloudy in the morning. mostly cloudy this afternoon. still off and on rain. but nothing too heavy. temperatures 50s and also 60s. some mid-60s for a few. these and also to the south. the system is gone by tonight. maybe some patchy fog tomorrow. but it will be dry and sunny and warmer weather, friday into the weekend. thank you. a new demand.

used expired travel visas. rodrigo says it's hard to adjust to life away from his friends. >> i miss my school. i miss my teachers and i really want to be over there. >> i want to help rodrigo come home. we study important people like rosa parks, martin luther king and cesar chaves. i think we can do a lot to help rodrigo, too. >> the kids 4 kids measure supports rodrigo. and they are asking senator feinstein to intervene on his behalf. his classmates plan to go to washington next month and testify on capitol hill. the 15-year-old from pakistan, the one shot in the head by the taliban because she fought for the rights of woman. she has a new school to go to. she is attending school in england. she was shot by a cam on the way home from her -- gunman on the way home from her school.

she was released from her home last month and wants all girls to be able to go to school. some employees at google's new satellite campus in mountain view may have been exspokessed to a chemical that's linked to cancer and birth defects. the center for investigative reporter says more than a thousand employees work in two bigs where -- bleddings say -- buildings say two chemicals were released. pregnant women exposed to this chemical have an increased level of giving birth to a baby with serious heart defects. the airline that has the most boeing dreamliners is reportedly making a new demand of the airlinemaker. a source says all nippon airways want them to compensate because of the grounding because of the batteries.

car allowances while also driving a city car. last year, two dozen demonstrators demonstrated at city hall she says most of the charges against her have not been proven. we've had problems in our commute, sal. where are you starting now? >> we're starting at the toll plaza. things have settled down. earlier this morning, i think people have been going faster. this is just a theory. i even saw a tweet from the chp asking drivers to slow down. but now things have dried up a little bit. here at the toll plaza it doesn't look that wet. the traffic is backed up for a 20, 25-minute delay. on interstate 880, the same things goes. the traffic is looking good. if you are driving through. but southbound 880, we have a big traffic jam developing. look at the road sensors here from mowry avenue -- i'm sorry. we did this wrong. i want to do this.

from mowry avenue -- or from 238 to mowry avenue, 41 minutes. that's kind of a long delay. that's about almost three times what it would be if there were no traffic. now we can go across the bay and show you from 380 to 92, that's more like it. it's a pretty light commute. 7:25. let's go to steve. thank you, sir. still a lot of cloud cover around. a little bit of rain. heard from kirk up in mendocino rain. he's still 19 inches below average for this time of year. he has had some rain. turning colder up there. there's colder air to the north. a lot of cloud cover. you can see in the last few frames, some of that is starting to slide east and south. i think later on today, we'll get a few breaks in the clouds. overall, a cloudy morning, mostly cloudy, turning to scattered showers this afternoon. 50s on the temperatures here. no cold air has slid in. livermore says 55. you can see the source of the stronger low went up to seattle and portland. we have a lot of moisture

7:30. we're tracking developing news out of bethel island where a fire that damaged two homes is still burning. the fire first broke out around 2:30 this morning on taylor road. ktvu channel 2 reporter claudine wong is live with a look at the flames and information on the damage the fire has caused. claudine? >> reporter: well, tori, that aerial truck is in place. when we last checked in, we talked about this attack from above here on bethel island to try to get this fire out. i'm joined by chief henderson from the east contra costa fire department. is it working, i guess is the big question. >> yeah. we're making good progress. as you can see, there's no

visible flames and the smoke is there. we still have a lot of work to do. we can't do the work from the inside out. we're having to do it from the outside in. so it will be a long, slow process. >> reporter: you said if you turn off the water, it will still flare up. it's still hiding inside the home? >> there's a lot of hidden spaces in there where the roof is sandwiched between that and the walls. and normally we would be able to pull the walls down and find it but we have to do it from the outside. >> reporter: now that we have daylight, we did show people what's happening -- we can show people what's happening. that was a problem this morning when you got out here? >> it was a huge safety problem. the first engine, fully

out from the top of this roof but unlike the last couple of hours, no flames, they still think there are flames hidden in there but they are gonna keep pouring water on this, keep trying to get ahead of this and we'll keep an eye on this for you and check back in on "mornings on 2." claudine wong. >> ktvu channel 2 news. >> thank you. 7:33. this morning a school employee checked the grounds around a san jose middle school where a man was shot last night. the victim was wounded while standing on the sidewalk. ktvu's janine de la vega is live at fischer middle school on hopkins drive with some reaction from a teacher. good morning, janine. >> reporter: good morning, tori. school is about to start here at fischer middle school. we do know from a teacher who works here, that some sort of e- mail was circulated to the teachers, telling them about the drive-buy incident. some of them -- drive-by incident. some of them surprised. a young man was standing on the sidewalk when he was shot last night. it papped just before 8:00. police started to get 911 calls

that there was gunfire heard on hopkins drive. officers say a man who appears to be between 18 and 20 was standing near the middle school when a light-colored suv drove by and someone inside started to shoots. the man was rushed hospital. he did survive overnight. police are monitoring the situation. it's unknown if his injuries are life-threatening. we spoke to a teacher who works nearby who says he received an e-mail. this is what he had to say about the shooting. >> it was surprising it would be happening so close to the school. >> reporter: how badly do you want answers? well, i would like to know, you know, what was behind it. it was a drive buy. i would imagine it was somewhat gang-related. >> reporter: investigators don't have a motive yet, and they are still waiting to get a detailed description of the suspect or the vehicle. we know from police that this area which is located near king

is known for gang activity. but police have not said this is gang-related. something we're looking into, that teacher that you jest heard from said in the e-mail that it -- just heard from said in the e-mail that four people may have been involved in the shooting and they may have been ex-students from one of the schools around here. we'll check to see if there's any truth to that coming up in the next hour. janine de la vega, ktvu channel 2 news. >> thank you. 7:35 a pleasanton preschool is reopening after a former teacher was accused of tying up a 2-year-old. center pointe has been closed since last week for retraining. investigators say the 24-year- old teacher bound a toddler's wrists and ankles with masking tape when the child refused to take a nap. the teacher reportedly showed a cell phone picture to co workers. one of them was the girl's

mother. police say church elders have been cooperating with the investigation and the teacher has been banned from working at any preschool. an assemblywoman joan buchanan has been drafting two bills targeting child abuse in schools. one bill would require districts to adopt certain reporting guidelines and review them each other. the other legislation gives the power immediately to remove teachers in child abuse cases at any time of the year. 7:36. conflicting reports this morning about how many u.s. marines were killed during a military training accident monday in nevada. yesterday, a memorial was held for the victims right near the hawthorne army depot southeast of reno. the veterans of foreign war says an eighth marine has died. the death toll is still seven, they say. a mortar exploded prematurely on monday. the pentagon has removed all of those rounds from training exercises and also in afghanistan.

new this morning, investigators in south korea trying to find the source of an apparent cyber attack. computer networks at three south korean tv stations and two major banks were hacked. the computer shut down all at the same time and then some skulls popped up on the computer screens. it's speculated north korea is behind those attacks. 7:37. well, it is the first day of spring and rain is expected off and on all morning. tara moriarty is in richmond where conditions are starting to clear but drivers are still being warned about some slippery roads. good morning, tara. >> reporter: good morning. that's right. the wet weather definitely putting a damper on a little bit of the morning commute. but it's starting to ease up here. we've noticed the rain has tapered off here over the past hour. we could still see showers on and off. the wet weather, a foggy end to a lackluster winter, although reservoirs are full, the

snowpack is only two-thirds where it usually is. we've seen accidents this morning in the north bay and solano county where they were earlier -- where there were earlier bursts of rain. >> any time we get rain, we do see more of the oils and other things in the road coming up and come out. it creates definitely more of a slick roadway, slippery driving conditions. >> reporter: slowdown? >> yes. >> a slowdown. please slow down. >> reporter: steve paulson will let you know when it will completely clear up. just remember to go the speed limit, keep a good braking distance between you and the car ahead of you, obviously and right now we're gonna check in with sal castanedo to see where the hot spots are, if you are seeing any wet conditions in any other areas. >> that's right, tara. we've seen fender-benders, people losing control and driving too fast. a lot of people have done that.

stocks are higher on wall street. the dow right now, heading into new record territory. the s&p 500 posting gains. the dow is up 66 to 14,522. the nasdaq is up 15. s&p up 7. now, these gains come as the european island nation of cypress seeks alternatives to a

bailout plan. its legislature overwhelmingly rejected this the day before. the bank says it will continue to give cypress emergency support, at least for now. but the international money fund and european union bailout plan included a tax on citizens bank savings and parly minute rejected that idea. banks in cypress remain close,ed a least through tomorrow. investors are waiting to hear what ben bernanke says at 11:00 this morning. that's when he will announce what was decided at the policy meeting. most think he will not have any changes to talk about. he thinks the bond-buying stimulus continues to help the u.s. economy. analysts also think he could point out that the bailout situation in cypress shows the ongoing risk of the global economic situation. 7:45. a teenager in petaluma, burned last night in a fire that allegedly started while he was making drugs.

police say it happened on east washington street. a 15-year-old boy is accused of starting a small fire while he was making hash oil out of marijuana. he was rushed to the hospital for treatment on burns on his face and hands. he was also given a citation to appear in juvenile court. this comes a month after fema issued an alert on hash oil explosions. the government agency says explosions at homes and hotels around the country are being traced to people using butane to get the active ingredients out of marijuana. in other news, senator feinstein is angry that the gun control legislation will not include an assault ban. harry reid says this will not be part of the legislation they will debate because it doesn't have the votes to pass. senator feinstein says the issue of gun control is a personal one for her. as you know, she became mayor of san francisco after george

authorities say the man who was killed by american canyon police pointed a metal object at the police that they believe was a gun. it turned out to be some sort of metal tool. now, the incident started when police tried to stop a pickup truck that had no license plate. that man then led police on a pursuit. it ended when he became stuck in a field. transportation officials in san francisco reacting to angry cabdrivers who took over a meeting for hours. [horns honking] >> dozens of cabdrivers packed this meeting and for three hours they unleashed a lot of frustration about possible plans to allow several hundred more cabs in the city. >> before you started to good the streets with medallions, there were enough drivers to cover shifts. there are not anymore. so if i have broken leg, i have

san francisco's city attorney wants the federal government to crack down on energy drinks. dennis herrera is urging the fda to require the amount of caffeine in the drinks be printed on the label. last year, the fda disclosed that five deaths are possibly linked to these beverages. the companies who make the drinks insist they are safe. and a new study says sugary drinks can kill you. researchers say they've linked 180,000 deaths widespread to obesity. the american beverage association says the study is more aboutsennationallism than science. 7:53. starting this weekend, disney will ban children under the age of 14 from coming into its theme parks by themselves. the new policy covers

disneyland, california adventure of anhaim as well as disney -- anaheim as well asdynyworld in orlando. the parents who often drop off their kids at the park for the day, they were alerted to the policy change. disney will start screening guests as they come into the park. if a guest appears to be under 14 years old, a parent will have to be with that child. 7:54. i want to check in with sal and see what's happening on the roads. tori and dave, in san jose, we've been looking at that particular intersection we've had a couple of spinouts here. you can see slow traffic here. the sun is coming up which will make it better for driving. by the way, in the same general area of the bay, an accident on the shoulder at san antonio road. the chp is on the way there. the bay bridge, that's been a steady 25 to 30-minute delay.

welcome back to "mornings on 2." i'm tori campbell. >> i'm dave clark. we have developing news from bethel island where firefighters are busy mopping unhot spots where a fire burned two homes. it started at 2:30. it's been a tough fire to fight. ktvu's claudine wong is right there. the very latest information with her. what can you tell us? >> reporter: within the last couple of minute, the firefighter on top of the aerial ladder came counsel. that's actually a -- came down. that's a good sign. we don't see any more flames inside this home, this brown home you are looking at right here. we've seen flames pop up and shoot up. the fire chief said he thinks

there are hidden spots right there. they are keeping an eye on it right now. they've been turning the water on and off. the firefighter came down. that may be a good sign. we have some daylight. you see the blue two-story home in the background and then this brown home in front of, right in between that, there was a single-story home. that's where the fire started. that home doesn't exist anymore. no one was hurt in this, but it was a really tough fire. a huge puddle, this home has flooded by the thousands of gallons of water they have used to fight the fire. you can see the fire trucks that are up there. we just walked up there in the last 15 minutes. we want it show you new video to give you a perspective. this was when the where the was coming down on top of the fire. you can see what they were dealing with in else it of

access and what they are -- in terms of access and what they were going through. there are no fire hydrants here. they had to use water tankers and the water from the slew to find of put this fire out. in one of the homes that was saved was a man who was very grateful this morning for the firefight. his home, mostly scalded. the fire did this. he talked to us. >> i couldn't believe what i saw when i walked outside. i tried to help my neighbor and i told my wife we're on our hone. get out the -- we're on our own. get out the hoses. >> reporter: he got out hoses as did several neighbors but it was not enough. they faced the huge fire already burning by the time it

was spotted. they had the no hydrant issue. they have a fire station a mile away that was closed because of budget cuts in july. there was a little bit longer of travel time for the next closest firehouse and then you had downed fire lines. the fire knocked down power lines at the brown hose that's still burning. that's what prevented firefighters from getting up close to there until 20 minutes. taking a live look, back here on scene, at bethel island, you are taking a look at the roof and the hole that broke through in the roof. that's a good thing. they were having trouble accessing the flames even though they were putting water on it, it wasn't getting to where they need to be. right now, it looks pretty good, not smoking of we've seen this before and have seen flames show up. we'll keep an eye on it and keep you updated on "mornings on 2."

claudine wong, ktvu channel 2 news. >> thank you, claudine. new this morning, the release of a new report aimed at improving oakland schools. the coalition of local community, education labor organization commissioned the year-long study. recommendations include moving up the date on when teachers are hired. the report says delays often allow candidates to find jobs in other districts. the study also recommends simplifying teacher evaluations. teachers say current ratings are too confusing and the group also advises lengthening the work day of teachers. report finds the workday of seven hours is among the shortest in california. we have an update from fremont police about recent copper thefts. on sunday, thieves robbed the pg&e yard on boys road. they escaped with $25,000 worth of copper. police say the thieves used a stolen forklift and a flat-bed truck. police say similarities to

another -- say there's similarities to another robbery. >> they took time to operate the forklift to remove that large reel of copper and then to load it onto a flatbed. >> police say the images the orange truck, they say that's their biggest clue. they say that truck was used to pick up one of the thieves. one man is described as being in his 30s. a suspect tried to hold up the 7-11 last saturday and the clerk ran out of the store after seeing what appeared to be a gun. the suspect left soon afterwars without taking any -- afterwards without taking anything. ail ka rez island is commember -- ail alcatraz -- alcatraz island is commemorating their

anniversary. this is now part of a national park. there's a special display of pictures that will open tomorrow. in a meeting that lasted until 1:00 this morning. danville town council approved a water-down growth plan after public outfi over affordable house. the plan designates two sites. that is significantly less over the previous acres. the vote came where residents spoke out against affordable housing. they say this faces a state mandate to provide at least some affordable housing. 8:05. a bird problem is a big problem for b.a.r.t. it's expected to cost b.a.r.t. millions of dollars. brian flores is live in fremont. so what is going on, brian? >> reporter: hi, dave.

well, you know, it certainly can be a dirty problem dealing with the birds and the problem and the mess they can create. >> b.a.r.t. officials say they are spending a lot of money to make sure the birds don't cause any more damage to their stations. the agency says they've spent millions of dollars to deal with birds in the area. $1million has been spent to cover crevices and lay down spike strips to make sure the birds don't land there. million -- another million is being used to help with problems at the daly city station and the 16th street mission station. ironically b.a.r.t. officials say the birds are atapping to measures like -- a. daing to measures -- are adapting to measures like spike strips. they are dealing with the bird cleanup. b.a.r.t. has been working around the habitat. crews are having to tunnel around a known bird habitat and

that's costing the agency about $5 million to handle that. hear what some riders noted. >> the cleanup would be an issue and concern for any traveler, any commuter. but i -- i hadn't noticed it. it was bad. if they need to -- if they feel they need to control the birds close to the station, that's -- that seems justified. and again, this continues to be an ongoing problem. a few years ago, bird noises were recorded. and even protective netting but those measures seem to have not been affected. what is affected, are the -- effective are the spike strips. there are spike strips through different parts of the station. you can see these throughout different stations. they also say that the recorded

the chp officer said someone passed limb doing 80 in the rain. if you are driving on 880 southbound, there's some slow traffic from hayward to fremont. we had a minor accident from there as well. no major problems, though it's very, very slow. across the bay, it's much better. that traffic time is down. let's go to steve. some rain out there. not a lot. a little bit. temperatures on the mild side. cooler up to the north. some decent rain in mendocino county. jerry tweeted that let me know that willits had some rain. somebody is getting some rain. cazadero, .50. light rain picking up on the san mateo coast. sunny and warmer friday and saturday. next week, next week, i get e- mails from people. does it looks like good rain

we're looking in on president obama speaking with shimon peres. they are speaking to the media. we're hoping to hear from him very shortly. the white house says this trip is a chance for president obama is connect with the israeli people. a poll published last week shows only 10% had a favorable attitude for him. president obama and israeli leaders both agree that something needs to be done to keep iran from developing nuclear weapons. israel threatened to take military action if iran appeared to be on the verge of having a bomb. president obama pushed for more time for peace talks but says military action is still on the table. president obama once hep weres up his -- once he wraps up this conference, he will head to speak to benjamin netanyahu where they will hold a press conference in about three hours. back to you. >> thank you. a sheriff says it appears a

911 call to a middle school school in southern minnesota was a hoax. the school in new prague, minnesota immediately went on red alert and locked down each class when a caller said there was someone with an ak-47. a search of the school turned up nothing. they say everyone is southwest. this school is 45 miles southwest of minneapolis. there are about 875 students at that school in grades 6th through 8th. an ohio teenager has been sentenced to life in prison without the possibility of parole for a school shooting that killed three students and wounded three others. tj lane expressed no remorse for the killings at chardon high school when he appeared in court wearing a t-shirt that red "killer." he taunted and smirked at family members of the victims as they asked for the maximum sentence during the emotional hearing. things i'm looking forward to, i will never get to see, my baby brower graduate high

school, go to college. >> lane pleaded guilty to murder charges last month, shortly before the first anniversary of the shootings. he did not qualify for the death penalty because he was under the age of 18 at the time of the shooting. 8:18. a new lawsuit claims the public has been misled by high-speed rail officials. the palo alto weekly reports the california high-speed rail authority is being sued by critics who say the rail line is not financially feasible. they also claim the decision to launch the pro eckt j in the central valley is illegal. the critics same claim officials don't have the funding to finish the san francisco to los angeles project. very serious accident on hayward's new one-way loop put a motorcyclist in the hospital. a truck and motorcycle were were going west on a street when the truck hit the

motorcycle. the man on the motorcycle fell and broke his leg and elbow. police say the crash is not related to the recent traffic changes out there. the chp is investigating whether a crash in vallejo last night between a fed-ex truck and a pickup truck was caused by the rain and wet roads. that fed-ex truck was dangling off the side of the road. this happened on highway 37 just west of fair ground drive. there's no word of any injuries. the onramp was shut down for several hours. 8:19 an original organizer of san francisco's carnivale celebration is being brought back in to save the event. ♪ >> this year's celebration is scheduled for may 25th and 26th but the event is in financial jeopardy than and there's talk of canceling the 34-year-old tradition. roberto hernandez organized this for 23 years and says the event is just too important to

cancel. >> one of the most positive things that comes out of the mission district is carnivale. it brings people together for one weekend to co-exist. >> fund-raising is underway. $20,000 has -- 120,000 has been committed. they need more volunteers and more money. the city is now looking into why they are in financial trouble. how vandalism is worrying some oakland business owners. en. >> they just went up and just sprayed every one of these businesses. >> who these businesses are turning to, to turn things around. and steve paulson will tell us when the skies will clear. you have a big backup on 880 northbound approaching high street. we'll tell you what is causing

8:23. the man accused of robbing the oakland museum of california is now facing federal charges. andre franklin was arrested march 3rd. police say he stole a gold jewelry box and a miner's scale from the museum. he's accused of selling the jewelry box to a business owner, then demanding $10,000 from that business owner.

franklin allegedly told the business owner he would turn him into the police for having stolen property if he didn't pay up. 8:23. oakland business owners are asking for help after a string of vandalism. the area being targeted is 17th street between franklin and webster. over the weekend, someone filled every door lock and padlock with glue. owners have also reported graffiti and damage to outside decorations. >> now this woman's window was broken out so many times until she just closed her business and went out. >> he this say a security team patrolles area during the day but someone is needed at night. some owners are asking groups such as the hel's angels and black panthers to step in. a branch is already being asked to come in this weekend. sal, you are watching 880.

8:29. we're getting new information just in from san jose about a drive-by shooting yesterday outside of a middle school. it happened on the sidewalk outside collide fischer middle school. janine de la vega, you've been out there since 4:30 this morning. the police just told you more about the victim. >> reporter: dave, that's right. they are saying this is a juvenile. this was a teenaged boy under the age of 18. this shooting happened near fischer middle school. school just started. the superintendent as well as

other district officials are here. we just spoke to them. they say it's upsetting that this shooting happened. the staff heard gunshots last night and came out here to help the victim. they tell us two or three young people were out here with the victim when it happened. police say a teenaged boy was standing on the sidewalk outside fischer -- fischer middle school when a light- colored suv drove by just before 8:00. the window opened and someone inside started shooting. the boy was hit and is suffering from at least one gunshot wound. he's at the hospital and suffering from nonlife- threatening injuries. police don't have a motive but are looking into the possibility this was gang- related. , again, we have just talked to the superintendent who said they will be meeting with police today. >> it didn't involve, as far as we know, activities on campus. it weans directed at the school. we have a lot of staff here. we will be communicating to parents the information about what happened yesterday so that they are clear about the facts of what happened and what we're

doing ma shake sure the school runs properly. >> reporter: we do know that an e-mail was sent out to the staff here at the district explaining what happened. we know that the staff recognized some of the boys that were with the victim last night. they were here because there was some sort of meeting going on last night. they tell me that there is a possibility that the victim or those other boys with him may have been former students here from fischer middle school. the superintendent told me that right now they are looking into the records to see at all if that is true. so they can't confirm that just yet. reporting live from san jose, janine de la vega ktvu channel 2 news. police say 83-year-old nicholas paul tutino was last seen liening his home in danville yesterday afternoon. there's been a silver alert

issued. police talked to him. they say he sounded disoriented and think he may be driving a green camry. we're a week away from the day the u.s. supreme court will hear oral arguments on proposition 8. next tuesday, the court will hear arguments for and against prop 8 along with the challenge for the federal defensive marriage act. the supreme court will release same day audio of the arguments presented. the court rarely does that. the court's statement did not mention television coverage, which legal experts say it probably means that will not be allowed. a troubled carnival cruise ship will be out of service longer than expected. the triumph was crippled by an engine fire, leaving more than 4200 people stranded in the gulf of mexico for several days. the cruise line says the ship will not be back until june

13th to make time for safety improvements. that means ten additional cruises will be canceled. 8:32. a bay area consumer group warning about possible hidden fees with oakland's municipal i.d. card. the city created the cards in part for undocumented immigrants. a debit function was offered later to offer banks services. but they are saying cardholders are charged $2 when they enroll for federal benefits and then they are charged a dollar every thyme federal benefits are put on the card through direct deposit. social media is helping the walnut creek police department. on monday night, christopher roberts turned himself in. he was wanted for several burglaries and battery. walnut creek police say he surrendered after they posted his photo on their facebook page. a san francisco association of tech companies is taking on the huge issue of homelessness.

better on 280 southbound as you leave the city that way. let's take a look at the bay bridge toll plaza. that's improved quite a bit if you are driverring to get into san francisco i think this would be a good way to go. if you are driving on the peninsula, traffic on 101 southbound looks good. but the hayward to fremont commute, still very slow although it's improved quite a bit. it was about 45 minutes earlier. we're seeing improvement as you head south on 880. let's go to steve. cloudy skies. a little bit of a breeze has picked up. more clouds than light rain. fremont, san jose, santa cruz mountains. plenty of cloud cover today. not too many breaks. temperatures would be kind of muggy. coming up from the southwest, of this moisture, still some rain. this system will eventually slide east and and -- east and south. you can see some of the rain stretching from fremont back to san jose. somebody's getting some rain at least a little bit here.

we're not done quite yet. back to santa cruz. some of that precipitation continues to work its way in. it's here. well, maybe not. hiding and sure enough, it was still smoking and in the last 20 minutes you saw flames coming through the roof. i just talked to the fire chief and he said we're gonna put more where the on it. we've had a ton of water, thousands of gallons of water on this home. the owner said they trucked in cedar from washington and the floors, also wood. that wood came in from canada. they built this house back in the early '90s. this morning they've been sitting 0 ut here just watching it burn. the -- sitting out here watching it burn. so much loss this morning by this fire that started about 2:30 this morning. if we give you a little perspective of what's burned out here, you have this house in front of us. there are two houses, the one- story home, that home is gone.

there's another two-story on the other side of it was that was saved, one wall of that kind of charred but otherwise is okay. firefighters got the call about 2:30 this morning we they got out here -- this morning. they got out here. then the power lines came down. there are no hydrants out here. they had to bring the tankers in and use water on the other side of. and then once the brown home started to burn, it was a question of getting in and getting close to it. again the situation at this point is that they are just continuing to throw water onto this fire that's very, very stubborn. they are not going into that area right there where the roof has collapsed. they said part of the reason, it's not safe. they are left to attack it from the outside which is a very slow and for residents as you can imagine out here, a painful process to watch. but this is the situation. they are gonna keep an eye on

it. they are not putting on where the right now. we expect that to start soon as they try to get a handle on the fire burning now for more than six hours. it looks like it's going to be a long morning. fire investigators are trying to figure out how the fire started. the priority is to get the fire out. claudine wong, ktvu channel 2 news. a teenager in petaluma was burned overnight in a fire that allegedly started while he was making drugs. police say it happened on east washington street. a 15-year-old boy is accused of starting a small fire while making hash oil out of marijuana. the teen was taken to the hospital for burns on his face and hands. he was also given a citation to appear in juvenile court. this comes a month after fema issued an alert on hash oil explosions. the government agency says explosions and homes and hotels around the country are being traced to people using butane to extract the active

ingredients from marijuana. 8:49. a christian preschool in pleasanton reopens today after a former teacher was accused of tying up a 2-year-old. center pointe christian preschool has been closed since last week for retraining of its staff. investigators say 24-year-old angela kahkano tied up a child's wrist and ankles with masking tape when the child refused to take a nap. the teacher reportedly showed a cell phone picture of the tied up child to her coworkers at a party. one of them, the girl's mother. the teacher has been banned from working at any preschool. joan buchanan has drafted two bills targeting child abuse in schools. one would require school districts to adopt certain recording guidelines and re-- and review them every year. the other one give the school districts the power to immediately remove teachers in

child abuse cases at any time during the school year. ten minutes before 9:00, thanks to a new bill, california's ban on foie gras could be overturned foie gras currently banned is made of the liver of the duck or goose that's been fattened. now a state senator has introduced a bill to restructure animal welfare standards. critics say this is a backdoor approach to overturn the ban. san diego's mayor has ordered a beach to be shut down overnight for two months after getting reports that seals there have been harassed. the mayor says the beach at the children's pool in la jolla will be closed from sunset to sunrise until may 15th. the announcement comes after a seal cam run by the city showed people kicking, punching and sitting 0 the seals that use -- sitting on the seals that use the beach. well, santa clara city council now officially behind
